I posted before about this the company I work for has tried this in the past but immediately shut it down due to being against the law .
Now they have brought it back stating that company policy is that any breaks outside of our two 10 minutes and our one hour lunch has to be clocked out for they specifically stated bathroom breaks even though the Fair Labor act States a company cannot discourage or require an employee to clock out for a bathroom break that falls underneath 20 minutes after informing them of this multiple times before which cause them to stop this they brought it back and today I brought this to their attention again and they are now stating that if we go to the bathroom outside of our lunch break or our 10-minute breaks we must clock out or we must get an accommodation for multiple restroom breaks how can a company get away with this, can someone explain this to me ? I sent them copies and screenshots of this law and I was told no matter what policy states within the company that we must clock out and if we don't our time cards will be adjusted which I informed them would be considered wage theft.
They state going to the bathroom multiple times throughout the day even if it's just 2 minutes is US stealing from the company are they in the right or am I in the right by telling them they cannot legally do this?
