California. Ive been employed ~7 months with this company. They decided to remove %80 percent of people (me included) on my shift(3-4days/ 12hrs)and move them to 5 days/8-10hr shifts. It wouldnt be a problem but my child care is dodgy for the extra days and extra expense are incured for childcare and gas(gas is negligible tbh) i have had to use pto/call off the last two days because i wouldnt have anyone to watch my 6yr old. Last week (Day after Labor day) was the first day of my new schdule and i was able to complete the 4 day week. Id make about 1400 aftrr taxes compared to 900 with unemployment.
My main concerns are i didnt sign anything to say i agree to the new schedule. Would me complying with the new shift be an acceptance of the switch. After how long? Ive read about constructive dismissal would that be the case here? Id rather not spend extra money on child care when i could just get unemployment and get anotherjob that can offer me a schedule i can work with.
