Just got fired- but what if they don’t replace me and eliminate the position?

So, I was just fired from my job for failing a secret shop (US, CO), despite not having any previous write ups. I was the acting property manager for a townhouse community. My official title was assistant, but I worked alone and did all day to day operations. I had a property manager when I started but she transferred and was not replaced. Pretty sure this is illegal (to fire instead of lay off), and shouldn't be hard to prove if they don't hire anyone or advertise the position (they haven't). Just not sure what the course of action is to get my 3 months lay off pay, instead of just filing for unemployed.

Anyone?
