I work maintenance in an industrial warehouse in Colorado. I am paid hourly. I was provided a cell phone to use at work. I only use it for work purposes.
Unsure if this next paragraph is relevant:
We have a rotating shift of being “on call”, which means that we have a separate phone that we are required to have on and we are required to answer when someone calls. This shift is for one week out of every eight, or so.
My team lead has repeatedly asked me to take my work phone home and I have consistently not complied. He, and anyone who might need to reach me, has my personal number. I have told him that if he needs to reach me he can easily call that number (which I would not likely answer, but that's beside the point).
Now, I know he is being a whiny baby and just trying to be controlling, and I know his entire position is irrational. But I am struggling to find any colorado laws regarding this concept.
It would be great if anyone could help me find a law or regulation concerning whether or not I would ever be required to carry a work provided cell phone off the clock (not counting my previously discussed on call situation, which in itself, is total bullshit {but, that's another story}).
All I can find is laws saying that all work needs to be paid, but not exactly what constitutes “work”, like, is babysitting and having to take responsibility for company property (the phone) considered “work”?
I'm at a bit of a loss here and this dude is trying to flex his manager muscles for no reason. I'd love to (legally and metaphorically) bitchslap him with some information.
