Interviewer said they’d consider it “quitting” if I set my hours to 0hrs/week

Interviewed for a family owned restaurant and explained that I'm looking to work a few short days a week for extra income, but that I may be going to school out of state in September. I mentioned that I'd be willing to return to work when I'm back home for holidays/summer/etc, which several college students did when I worked for a fast food chain. The interviewer said “if I see your availability go to zero hours a week, I'd assume you quit and would treat it as such. You'd need to request vacation time instead.” That's not legal… right? I'd assume they'd have to terminate me in order to end our employment contract? This was an immediate red flag and I will not be working for these people lol. It just makes me wonder how many people they've gotten away with doing this to in the past.
