The right to disconnect…. or not!!!! Question for you all.

One of the few good things my company does is, we have a 'right to disconnect policy'. This is taken from EU legislation and actually upon reading it, has real substance. Essentially, employees have the absolute right to disconnect from all forms of work outside of their contracted hours. Which I 100% do. I clock in on time and out on time and to be fair, I am never pulled up on it. But here is my question, while I stick to my 'right to disconnect' my boss and his boss routinely email and text (whatsapp) myself and the wider team out of hours. They are not expecting us to reply in all cases, most of the time it is information for work later that day or the next day. I have counted on Whatsapp alone, over 20 incidents of this since January. In email it is every single day.…

Lately I am starting to find the volume of emails I come in to every morning, passively aggressive. I could be wrong, but it feels like an attempt to highlight how much work my boss does and his boss. The volume of late night emails is increasing and it definitely bothers me every morning to wake up to. What are peoples thoughts on this and are there any grounds for me to say something in this case?
