Boss took $1000 out of pay check for customer issuing charge back.

Hey all I figured if anyone would know how to go about this y'all would. Long story short: car dealer sales person sold a vehicle. Vehicle was damaged. Dealership took the vehicle back. And canceled the transaction. They were supposed to refund $1000 deposit. They did not. Customer filled dispute/charge back with credit card company. Dealership owner took the $1000 out of the sales person's pay because it was his customer. This is in Texas if that makes a difference. First is this legal? Second what can be done about it? Long story: I put a deposit down to buy a car (toyotas are basically impossible to get these days for what bs reason). Vehicle came in they delivered it to me when the sun was setting. Go out the next day and realize there scratches over 90% of the vehicle. Parts were missing. Weather stripping was all chewed up.…

This is in Texas if that makes a difference. First is this legal? Second what can be done about it?

Long story: I put a deposit down to buy a car (toyotas are basically impossible to get these days for what bs reason). Vehicle came in they delivered it to me when the sun was setting. Apparently turkey vultures like to eat weather stripping and had claimed all over the car. They also failed to install parts and parts were missing. They took the car back to the dealership to fix and failed miserably. I told them I'm not paying for a brand new car that's damaged all over. Threatened leaving bad reviews for the dealership and the took it back and canceled everything. Thankfully my credit union hadn't mailed the check out yet for it. They were supposed to bring the deposit check when they picked it up the final time.deposit was also supposed to be applied to the sale which wasn't (list goes on n on about how crappy the dealership is) then said they'd mail the check. Check never arrived so I filed a dispute withy credit card company. The dealership really should have just refunded it through the credit card but who knows. Anyway come to find out from the sales guy (who did an amazing job, best sales person I've ever had) that they took the $1000 out of his pay because I was his customer. The credit card company is still processing dispute. I have not got my money back as of yet, and they're not out the $1000 as they have the vehicle. They're basically just taxing the sales guy on my behalf. Which is all sorts of wrong and fucked up imo. Dealership owner won't talk to me or return my calls. Is what they did even legal? What would you recommend I do?
