I have a friend who recently was hospitalized and wasn’t able to work. In addition to mishandling my friend’s unemployment paperwork causing him to have to wait almost 3 months to receive any benefits, once he did return to work, they garnished 100% of his paychecks to pay for insurance premiums. As far as I understand it, the Federal CCPA would limit garnishment in this case to a maximum of 25% of his wages. I don’t believe a state law (Missouri) could trump this, but IANAL. I told my friend I thought he should report his employer to the state labor board because even if it doesn’t do anything for him, they will keep doing it to others if they keep getting away with it. So my question is, does anyone know of a reason why the 100% garnishment would be legal, and if not, does anyone know how to file a complaint like this in Missouri?
