It’s a little complicated so I’ll do my best.
My dad(50+)lives in a mid west state but is hired to work out of state, in New York State, on a “tech construction” project. Project started with doing the general labor to get to know the industry then quickly started to move up the ladder and became a QA/QC type role.
One day he was moving something heavy and pulled something in his shoulder and filed workman’s comp and everything seemed fine as he continued to work out his injury with doctors and visits he was still at work. Obviously work knows about it or he wouldn’t be getting coverage from that. So week by week for a few months, his injury festered into his arm compensating and further injuring him self thus extending the workman’s comp because it’s related to the first injury. While his condition worsens he makes some small mistakes along the way and the “final straw” is that he broke something (on accident of course). So they fired him.
He is devastated. Hurt. Confused. And angry. This man has gone through so much in the last decade and he finally felt he was above water. Now his life uprooted again.
He is contacting a lawyer next week. He believes that what they did was illegal. But I certainly have doubts if he could win or get a settlement.
There are somethings that I may have left but that was the majority.
