Fiance and his direct supervisor (Night shift) were threatened at work. They reported together and the day shift supervisor and manager refused to do anything about it, they wanted to give the guy a free pass (they were all friends). So fiance and his supervisor took it to HR with a few witness statements and the guy who threatened them was terminated.
Since then, Fiance has been having trouble with the day shift supervisor trying to get him in trouble for literally anything, but so far nothing has stuck… Until fiance took a sick day.
The day shift supervisor (not even fiance's direct supervisor) gave him an attendance point for the day he used sick pay. According to him, If you've had 2 or more absences in a quarter, then you can be pointed for sick pay days.”
So fiance still got paid for that day, but is now facing an attendance point for it. But here's the thing, we both looked over the manual and that's not what it says. Furthermore, other coworkers as well as the night shift supervisor also disagree with this interpretation of the company's policy.
Absences and sick pay days are categorized as two separate things in the employee manual. Absences are considered chargeable offenses whereas sick pay is categorized as a “Non-Chargeable Incident.”
“The following are considered Non-Chargeable Incidents:
Consistent with the Procedure and Disciplinary Action Limitation of 2 Sick Time days per quarter, the associate as available Sick Time to cover all the scheduled hours of absence, unless the absence is a No Call/No show.”
It would make sense if Fiance were using his third sick time day for him to be charged an attendance point, but that isn't what happening as this is his first time using Sick Pay, it wasn't previously available to him.
His previous call in's were just considered “Absences.”
He's left a voicemail for the main HR lady who handles these things in hopes of getting some clarification on whether or not this point could be legit. But based on reading that, what do you think? Would sick pay days be chargeable if absent 2 or more times previously or would it only count if you've used 2 other sick pay days?
I'm not sure if this is the right sub for this, if not please forgive me and feel free to direct me to the correct sub. It's causing an unholy amount of stress in our household and fiance is planning on finding a new job after putting up with all of this for so long.
