I need help figuring out my next steps against my former employer. It’s a complex story but I’m keeping it short.
-Model employee (sales for a SaaS) company
-Got fired last week after they found “discrepancies that led to my commission being overpaid.
-They sent a document stating I input false info that led to $19,000 in additional wages. This document was voided 20 minutes later with no explanation. They won’t send me the investigation report.
-It’s literally impossible to over pay yourself or fudge numbers because we are paid on the payments for that quarter. This isn’t just a lie, it’s a bad one.
-Paid me on Tuesday for all of my Q2 deals and deals owed to me from Q1. I’ve been paid for every in the last year.
Leverage
-I filed a complaint a month ago in regards to $25,000 missing in my q1 commission plan due to then changing the plan after the quarter. I also complained how we hired six people, all of different ethnicities who are making $19,000 more than me for the same work. I also brought up a few smaller topics. I got fired three weeks later.
-This company collects a massive amount of data for other companies. They claim to be GDPR compliant and every other compliance around. This isn’t true and I have proof. How do I leverage this knowledge? Exposing them would shut them dow.
The state of jurisdiction is CA. I have the right to arbitration paid for by the company but the award is capped at $200,000.
I want to maximize the amount of money and bad publicity they can get. Help? I can provide more details as needed.
