My job still has not paid me money promised. Luckily I found a FT job elsewhere at what seems like a healthy employer and company.
I am planning on quitting tomorrow if they do not give me an exact date for when they will send me the money owed. It’s been two months so if they can’t give me a date tomorrow I assume they don’t want to give it to me anyway as they have already made getting past wages promised difficult.
I’m planning to file an unpaid wages claim (for my state and federally) as I have emails and text messages stating what we have agreed on.
I know that even if I file, it’s not 100% that I’ll get the money back but I think it’s worth a try.
Any tips on how I should go forward with this? Should I tell my employer I’m going to file if they don’t pay? Or should I just send a resignation letter and not tell them? Can I file both a federal and state claim at the same time or should I start with one?
