Hi, I am looking for guidance on what to do in this situation…I was assaulted in the workplace two nights ago by an aggressive employee (struck me in the side of the neck/jaw) because he thought I said something to him (I didn't), and it appears as if the business is not going to terminate this person although they are fully aware of the situation and there were two witnesses. This is a family run business and this person is part of their family. There is no HR department or corporate or anything like that. Its a mom and pop operation.
I am unwilling to return to work to put myself in this position again although they would still like to retain me as an employee. I am quite sure this is illegal in some way by required workplace standards if they refuse to terminate this person. I did contact the police and have filed a report though I have not currently pressed charges against the employee.
The police basically said it was unlikely anything would happen if I did press charges because I didnt have obvious injuries and there was no real significant loss on my end like medical bills or anything as a result. But ultimately this is going to put me out of a job (it is an extra job and not my primary one but I still make about $1500 after tax every month there). I mentioned some type of civil suit and he seemed to think there wasn't much to go off of for it.
The other thing is that even if they do fire him, Im not even sure id go back because it is family run and it would forever be an uncomfortable situation since his in laws and relatives work there…so basically I feel like I effectively lost this job because of HIM assaulting ME.
