I am currently interviewing with a company. Well, I've been offered the job and accepted, and am now going through the rigorous hiring process which has almost taken two months to complete at this time and doesn't feel like it's even close to being finished.
Anyway, I was asked to fill out a background form that asked all of the usual questions. Ex. Have you ever been convicted of a felony? So on and so forth.
Now, there was a question on the form that asked, “Have you ever been convicted of a misdemeanor of any kind within the last 5 years?” To which I answered no.
They then did the background check on me and sent me a copy of my Rap sheet. 15 years ago, in 2008, I was charged with a single misdemeanor in which I was sentenced to 10 days in jail, did 8 and got out, and had a deferred judgement and special conditions. Effectively, don't fuck up or you're doing 6 months to a year.
Most of this information was on the FBI background check that the company sent me. However, not only did I not know they were doing a background check on my entire fucking life, but they are now asking me to send them documents of the court proceedings for them to review.
Is this legal? Can they literally ask me to send them court proceedings documents for their review? For a case that happened in 2008 when I was 18 years old?
Tl;dr: Can a future employer ask me for court proceedings documents based on a misdemeanor from 2008 for their review?
