I live in the US and work for a county government in a mid-west blue state. I'm one of two foremen and we have an immediate supervisor I'll call A, along with next up the ladder I'll call B. Supervisor B likes to micromanage and has allowed a toxic work environment to grow and fester. We're shorthanded and they have looked the other way in the case one worker who likes to avoid doing what is assigned to them. Granted nobody likes to work but the rest of have to pick up the slack. Another team member gave his 2-weeks notice a short time ago and used his PTO and sick time for the last week. The other foreman, Supervisor A, and I have all been looking for other jobs.
At the beginning of this past week on Tuesday, supervisor A gave his 2-weeks notice. Yesterday morning on Thursday, A puts in to use his vacation time next week, he has two weeks coming. That's when it kind of hit the fan. The manager and B decided an exit interview was needed with A before noon. After A let them know his reasons for leaving, the manager told him since he didn't give a full 2-weeks notice, he doesn't get his vacation time and it will be forfeited. When A informed me of this, I asked if he still had his employee handbook, which he did. I told him to look up the policies concerning all paid leave, that not paying him was illegal. Last night when I got home, I looked up law on our state's website. I texted him the link to the law, the section it was in, and cut and paste the section into a text. After reading the employee handbook last night, he found out they have to pay him out on his sick time also, about 35 10-hour days. He had to work a half day this morning and was going in armed. I'm really wondering how it went. If they decide to stand their ground, I have other ways to mess with them.
