Hi so my Mom works at a popular big grocery store chain, back in June she lifted something got chest pain and I took her to do the ER for a day. No precondition, she is healthy, this is 100% injury at work. All was good and she was released. HR gave paperwork to briefly describe what happened and to sign. She did all of that, bill came in and it was billed to personal insurance and has around a $1k patient pay. Kept contacting HR to say I need workers comp claim number, however they keep saying they submitted everything they are waiting to hear back from corporate and haven't gotten anything back. It's been 6 months, I paid small amount just to keep it from collections. It looks like this was never filed and approved from the store manager. It seems like the store manager would like to keep these incident reporting to a minimum as they get bonuses if injuries don't happen.
I have talked to her Union which advises to go and push the manager for a claim to be filed, or to consult an attorney from the Union. In case manager doesn't want to file this, what kind of laws and regulations can I bring up and appeal to make him do it? I would like to try to push them to do it, making this much more easier than it has to be for all parties including myself. This is all in Illinois.
