I’m not sure if this is the right sub to post this. I’m also not sure if what my ex boss did was illegal. But this sub seems to support employee rights so I thought maybe someone could give some info.
So basically I’ve been a delivery driver at a local pizza place for the past about 8 years. It was owned by the same owner for the first 7 years and he sold it about one year ago. The way deliveries worked for about the first 6 years was every delivery had a delivery charge ($1, $2, $3 etc. depending how far it was). I was always told that as a driver I get to keep half the delivery charge and the owner keeps half to pay for driver insurance and things like that. Well shortly before the previous owner sold he was audited by the IRS. What they said was he wasn’t paying drivers enough per mile. So after the audit he raised delivery fees and told us we now get to keep the entire delivery charge and he would lower our hourly rate (ex: what used to be $2 fee I got $1. Now it’s $3 and I keep the entire $3). After he sold and left I heard he was just keeping half the delivery fees for himself and he didn’t need it to pay insurance or whatever, hence why he was audited.
So for about the first 6.5 years I worked there he was keeping half the delivery charges when I should’ve been getting the whole thing. I know it doesn’t seem like much when you’re talking $1-$2 dollars but that adds up to $10-$20 a night. I usually worked around 4-5 days a week so you’re talking $50-$100 a week. 50 weeks a year comes to $2500-$5000 a year for almost 7 years is almost $35k. Did he illegally take it or just a greedy owner?
