Do I legally still have to work for delayed pay?

Not sure if this is the sub for this or not, but I've seen you give others some really solid advice. So… here I am! Here's the situation: the company I work for is facing some financial issues, and we just found out no one will get paid this week. Boss says he hopes he can get us current sometime next week, but no promises on when. The contractors aren't working again until they get paid because they're hourly (good on them!), but I'm a salaried worker. Technically, I'm not paid for the amount of time I work–I get the same amount every two weeks regardless. Except this week because the pay is delayed. Here's where my dilemma comes in: immediately my thought was “well, if you aren't paying me, I'm not working,” but I'm not sure if I'm legally allowed to do that. Here's where my dilemma comes in: immediately my thought was “well, if you aren't paying me, I'm not working,” but I'm not sure if I'm legally allowed to do that. Technically, I'm still going to be getting paid for that time regardless of my number of hours worked since I'm salaried; it's just “delayed.”

I don't want to screw myself over and end up needing to pay them back for that week or take my full allotted PTO in the first week of the year, but there's no promise that they'll ever pay us again (or when that pay will come). I wish I had the 8 week PTO package my boss has, but I definitely do not.

So… at what point can I just… stop working? They aren't paying me right now and aren't sure when regular pay will be reinstated, but I am salaried. Idgaf about screwing them over (see my one week of PTO vs my boss' 8), but I don't want to end up owing the company money or not being able to take off the rest of the year.

All online advice says I should sue them (which, absolutely I will if they keep not paying me), but no where does it say I can stop working. I don't want to work for no pay or even “delayed” pay, and I could use some advice.

Thanks!
