My employer is not respecting my recently (12/6) placed medical restrictions. I started the complaint process with the EEOC, but their website says I need to schedule an appointment for an interview for the filing to be complete. Wouldn't you know, “There are currently no appointments available for this office. Please check back daily to schedule an appointment.” It looks like there aren't any available for the rest of the month. When I initially called to file the complaint, the phone prompts indicate you cannot file via phone and cannot schedule an interview via phone.
Anyone else experience this? What am I supposed to do in the meantime? I absolutely won't be putting my health at risk over a minimum wage job that has had a month to figure out alternative work spaces/tasks. Today, I was forced to use PTO to avoid working in an environment that caused me to vomit multiple times at work. I'm not even sure I had enough PTO to cover for today (I'm pretty sure I also now won't have enough to cover for two doctors appts next week that I was already had approved off. I have already filed a complaint with OSHA since I had concerns about the environment before I had my restrictions. (My condition is protected per ADA but is absolutely not a result of the environment; it's just been a concern of mine for quite a while.)
I'm in Massachusetts if that makes a difference. Thanks in advance for help/commiseration!
Eta: I have fmla leave planned due to my condition, and if I leave the job for another, I won't be eligible for it.
