Task rate / flag / piece rate workers are required to be paid at least minimum wage x clock hours + applicable overtime if their task rate amount is lower.
How does a corporate press release (publicly traded company) stating the company’s new nationwide minimum wage for hourly workers is 15$/hr affect this? Could I hold them to the $15/hr minimum wage or will I be stuck with $7.25?
I’ve seen FLSA state that when there is overlap with minimum pay like state minimum is higher than federal that employer must pay the most generous minimum wage. Is it a stretch to attempt holding them to their public press release figure if my state only adopts 7.25?
Since now they are not letting us clock out early when there is no work.
My piece rate is $26.50. It’s common in this industry when they cannot fire for-cause to protect themselves from unemployment chargeback to “starve out” employees on a pay plan like mine so the position becomes so economically unviable that employee voluntarily quits.
