Former MLB Player Andrew Durden and his partner owe me $8,125.50: Violated labor laws and LATE PAYMENTS

Agama LLC (“AGAMA”) has improperly classified me as an Independent

Per the agreement between AGAMA and myself dated Sept. 1, 2022, My monthly compensation of $5,417 Has not been paid for my work in the month of October and half of November. The total due for these 1.5 months is $8,125.50.

Per Paragraph 7.a of the Services Agreement, AGAMA is in default for “failure to make a

required payment when due.”

Truth is an absolute defense.
In my opinion, there is much more to say to protect myself.

The guise was pretending to be a potential client for this meeting and owning an art gallery. I feel ashamed for assisting her and joining this meeting.

Because I was excited to work remotely, I worked long hours even on weekends and holidays. I was genuinely happy to work for them initially. They were aware of the long hours that I worked and praised my work ethic. I resigned mid-November via email because of stress of late payments and also working long hours.

[ Multiple times I was told I would be paid and an excuse would come up.

Imagine being told by Andrew that you were being paid with Zelle and given a screenshot. Then over the course of a few days you call Zelle/Banks and there is no record. I was told by Zelle that it should have been sent immediately if it was sent. My September 1st paycheck was finally given to me but in the form of a Cashier's check which I cashed on October 21st, 2022). So now everyone can understand why on November 16th I resigned abruptly. My paychecks were always due on the 1st.]

I received an e-mail reply which was cordial and I responded via e-mail stating that I was not in a good headspace and explained in detail why I resigned.

When I was ready to talk I texted Andrew which he didn't respond to [text]. I gave him a screenshot of me asking another employer to reduce my consulting fee because I allocated more time and effort to Agama LLC. I was working full-time for Agama LLC. This was to show my sacrifice to Agama LLC.

I was genuinely a supporter.

That same week on a Friday I called and he answered. I aired my grievances about late payments and stress from the amount of work that I did. He appeared sympathetic and I was given the impression that I could rejoin the team.

The following week, on Monday, my Microsoft Teams account was still locked out and I was ghosted with no communication from Andrew and his partner Tonya. I was upset and realized that by being locked out of Microsoft Teams, it would be difficult to document the work that I did in case I was being screwed over. My texts were ignored. That was a supposed work day if I was “rehired”. Because all of my work was done and documented on Microsoft Teams I couldn't work at all.

So I reduced my consulting fee for another company because I wanted to give this company even more of my free time to support it….and look what I got.

In my initial resignation letter, I stated that my final paycheck would be Dec. 1st.

Dear Andrew and Tonya,

Please accept this letter as formal notification that I am resigning from my position as Business Integrations Specialist with AgamA. My last day is today, November 16th, 2022.

Thank you both for the opportunity to learn quickly and reach levels of productivity that I did not think was possible. I am very grateful for the kindness received and would like to leave on good terms. I am just burned out and need to focus on my mental health. I have attached my final invoice and payment details in the amount of $8,125.50 which can be paid within 15 days. (December 1st, 2022)

Suggestions: $5,417 per month can now be allocated towards development, Digital Marketing ads, or outsourced employees to save on costs. The Return on Investment will be much greater.

I have no assets. No full-time job. I had to borrow money from parents to pay bills and loans. Employees just want to leave on good terms and be paid for the work that they did (Which I have documented). What would have happened if I didn't have parents to support me?

Oh and the company address for Agama is owned by Andrew's partner's LLC in another state. Making it difficult to serve them “properly” legally. My demand letter for payment was sent to both Andrew's personal and work e-mail and remains unanswered.

What a mess.
