So as the title says I received the following text from our HR Director today:
“Typically, we permit people home with sick children to work from home, since they, themselves are not sick, but not necessarily when they are sick.”
This was in response to my asking if I should WFH today given I have a really bad cold and we've created an obvious pattern of getting one another sick in our office. For further context my other coworker has been permitted to WFH today as her daughter is sick.
My question is, is this discriminatory? Is this legal?
I've cross-posted this in r/legal but wanted to cover more bases.
Can companies establish WFH policies that favor those with children?
