I need to find a new job, can I use work from my current job in my portfolio?

So, for some context, I am currently working an entry-level position an advertising agency in the United States. Due to a generally bad workplace environment, I am looking to get a similar job somewhere else. I need to update my portfolio in order to apply other places, but I don't have any decent work outside of what I've created through my current job. This is an issue, BUT, when I started working here, I never signed any sort of contract or handbook. Basically, I've done no paperwork other than my W2 and payroll stuff. Can I use the work I've done at this job in my portfolio since I have not signed anything specifically prohibiting that? Are there any laws I would be breaking doing this? My workplace is extremely disorganized, so no employment contract of any kind has come my way, not even a specific job description or scope…

Also, I am apprehensive about asking my boss directly. It's a bit of a toxic environment, so I worry if I ask my boss for permission they might fire me on the spot or make my life at work hell until I'm able to jump ship. Anyone have any advice or experience in a similar situation?
