Hello all! Joined awhile back. Mostly a lurker but felt the need to ask a few questions.
In the past I’ve been salary management. I’ve always made sure that if an employee even went 1 min over their 5 hours. They were paid their break violation. I did anything and everything legal for my employees.
Due to covid finding work had been tough. Had a few jobs here and there. All being salary. I find myself back in hourly and feel my current employer is bending me over and taking my money.
Currently live and work in California.
Working 5×10 hour days. Noticing that our pay is based on this fixture but our 5th day is only 8 hour reg pay and 2 OT. Which doesn’t add up past the 40 hr work pay. Additionally due to the nature of the restaurant I work in. There are often times (90% of the time) that another manager is not there to relieve you of your duties for a lunch. We are required to stay on site, even if we clock out. It’s also expected you work through that shift.
At the beginning of my tenure I also had a GM change my breaks, or rather add them. With weekends being very busy there are times I never had time to “add a break”. Resulting in the management adding a break as opposed of giving me my break violation.
I’m at the end of this job as I’m tired of being worked like an idiot and not being paid for what I’m actually working.
Is there a claim to be had and what exactly? On both missing 10hr ot as well as the changing of hours and inability to actually rest?
