I am asking for a friend in New York, US. They got laid off 2 weeks prior to their scheduled vacation, they have 100+ hours of PTO accumulated. They were in good standing, and only thing going awry was that they were not going to office citing mental health reasons – and shared a doctors note citing it as well. Can they sue the employer for wrongful termination ? The reason given was position is no longer needed. They worked there for 3.5+ years. Not sure with the “At will” laws which are a joke.
