Last week my direct supervisor tried to violate labor laws. So I reported it to HR. Since then she has me under a microscope and I can’t do anything right, yesterday she wrote me up. Today I was sent home and told to wait for HR to call me in.

Two weeks ago I told my supervisor I was leaving for lunch she tried to convince me to stay saying, “do you have to go?” When I told her I had some personal business to attend to she said, “ok but this is the last time”. Now I know that when I’m clocked out it’s my time. I referenced the the employee handbook and California labor law which both assured me to be correct. So I took it to HR and I thought that would last I’d hear of it. But since then my name is mud to my supervisor. It’s been obvious that she’s on the offensive towards me and my job. Rewind Many weeks ago I agreed to sign a waiver that allowed me to not have to take my lunch within the first five hours of my 8 hour shift. Meaning I could take my lunch any time. California allows this because I agreed to it.

Despite that three days ago my supervisor wrote me up for taking a lunch last week after my sixth hour. Ok now I know she’s got it out for me. That tied to the fact that since the meeting I had with HR I’ve heard nothing from her but criticism.

So then today I was sent home and told to wait for HR’s call. No other details.

Is there anything you fine people can advise me that would help prove my case that I’m being targeted as retribution for knowing my rights and standing up for myself? Because for me it’s obvious. But how do I convince HR when they call me in to fire me? (I’m positive that’s what’s happening) Is there anything I can do to save my job? I really hate this job and I’m looking for something that fits better but I NEED the income.
