Long-shot about Paternity Leave in NJ

Alright so if this isn't the right community I'm sorry, but basically I work for a small company, about 45 people in the US and about 30 in our India offices. My Wife and I are expecting and I see this New Jersey Family Leave Act flyer in our kitchen that says up to 12 weeks of protected leave, but I just had some questions. I see it says company must have 50 employees or 30 employees as of June 30th, 2019. I'm assuming that means my company would qualify there (they had in the 40's during that time). It says up to 12 weeks so I'm assuming it's at HR discretion? Or is there something specific to that?
