Manager makes $1000 a week. Most of us are on Medicaid. One coworker is homeless. But manager still illegally participates in tip pool. What should I do?

To make a very long story short, our manager participates in tip pool. My state law says its illegal even if she is on the floor because she is considered an employer and has power over us. One employee brought it up and didn't split her in so she threatened to fire him, but he quit because she didn't give him a break one day. We brought it up to higher ups. District manager said none of her other managers take tips but she's not sure about the law. Then my manager said “technically tips are a privilege so we don't have to let you guys take tips. I only take them when I'm on the floor” (not true. She will sit in her office for an hour and still split herself in.) I'm afraid if I bring it up to someone, she will take away tips for us. But…

I think it's messed up. What should I do
