My friend’s Dad was fired with 1 year left before retirement for a failed drug test (THC) after having a heart attack (Kentucky)

Ello friends. Company in question is a trucking company in Eastern Kentucky. He has been a truck driver for them for 19 years. He had a heart attack in January & had been off the job for a month. During that month of recovery he had smoked a bit of bud to help with the pain & stress. He never failed a drug test for his entire tenure with company in question (19 years). Needed to work one more year to earn retirement with company. Company has a zero tolerance drug policy. He had not smoked very recently but returned to work and they told him he failed his drug test and that he has been fired. Details I know: Does not have a medical card (very new thing in Kentucky), he personally was not given his results. Is there any type of protection for this? Smoking while on medical…

Is there any type of protection for this? Smoking while on medical leave from work? Or is he just hit? He has already been hired by another trucking company, and he passed his employment drug screen (less than a week later).

I'm mostly just venting but if there is anything I can do, I'd love to help him out. Cheers!
