Disclaimer: I am not an attorney nor am I providing legal advice. This is purely based on two employers who treated me terribly and then I learned how to stack the deck in my favor. Subsequently, I won two settlements from future employers. I've seen a lot of questions on social media about this and I wanted to share my experience. If you have ever experienced a hostile work environment, retaliation, or violation of EEO/ADA, this list is for you. This is what I developed based on experience to ensure that you will be compensated and can prove your case if it goes that far. Document everything / Keep a journal This may seem insignificant, but it plays a huge role if you ever get into a lawsuit over what I previously mentioned. Yeah so I just got a new job and I missed the orientation. I got a packet which included the training guide and policies. I found many things in their policies that raised concerns, so I sent an email addressing them. They decide to schedule a meeting between my manager, the head of operations (who is apparently their HR as well), and I. I apparently threw them off and put a sour taste in the dudes mouth because I haven't even started working there and already had a list of concerns. Most of my concerns were how ambiguous their policies were stated in this handbooks, such as “makeup must be done in good taste” “hair must be done in good taste” “up to managers discretion” I merely assumed they weren't being specific enough and only raised concerns of how such ambiguity could lead to discrimination. Which they addressed and I…
My company does a time sheet thing, we get paid 8 hr days and it’s 8:00 to 4:30 with a 30 min lunch break. I been here for around 1.5 yrs and I always felt like I had to work til 5 each day until I realized that’s wage theft. (Especially since sometimes I don’t even get a good 30 min lunch) I wfh, so I appreciate that part. However, I shouldn’t feel bad clocking out at 4:30. My manager messaged me around 4:10, I told her I was leaving at 4:30 for a doctors appointment. I didn’t apologize, I one year ago I would have. Getting paid 8 hrs a day, im working 8 hrs a day. I appreciate you all on this sub for putting a light to this and making it right.
Entire night shift refused to clock in.
Oh how embarrassing!
Work / Life Balance
People directly or indirectly related to the company harass me outside if work. To the point where it becomes difficult to do anything. Hundreds of thousands of dollars have been spent on me trying to recover from the mental and physical difficulty had to endure. Not sure why people would do this to anybody. Working would be something that generates joy for me, and having to deal with external forces stopping me from working seems unbelievable.
