Scheduling going against State Labor Code?

So I was hired as a barista at Starbucks back in January, and from the beginning my availability has been wide open with the exception of Saturdays. For the first few months, I had no issues and I was never scheduled on a Saturday. However, beginning in May I began being scheduled every Saturday, every week – and it won't be until next Saturday that I finally get my agreed upon availability back. I had to specifically ask to get my Saturdays back, and then my Store Manager said I had to put it in as a time-off request to remind her. Honestly, I find the fact that I have to put in more effort in order to have my agreed-upon availability respected and followed to be very off-putting, but at least I got my Saturdays back – right? Sure, if it weren't for the multiple closing shifts followed by…

Getting Even Legally

I'm in a very bad place. Back in late May I was approved for up to 12 weeks of intermittent FMLA leave for two serious conditions. In July, my boss yelled at me for my FMLA absences and said she would be demoting me to an entry-level position (making only $15 for tech support). I was making nearly $70k in my current role. Otherwise I would have to leave. UT is the new California, so there was no way I could take that pay (Wendy's pays $16/hr. here). I explained disciplining someone for using legitimate FMLA absences is illegal, but my concerns were dismissed. To add insult to injury, Utah's Department of Workforce Services determined it was OK for my employer to do this and I was denied unemployment. To quote, I “didn't have sufficient cause.” But don't worry, all the years I worked UT was happy to tax me…

Workplace Training

This past week, my company added new annual training models regarding ethics, sexual harassment etc. One was based on workplace violence. It is supposed to term you what to look for, how to speak up, and my favorite how to organize your fellow workers to rush a gunman. Obviously I'm an American working for an American company. Friend of mine made a good point…. if they're so concerned about workplace violence, why can't we work from home? Why make us come into an office we dislike (45 minute one way commute for me) and where we are more stressed? I know it's all about control, but damn.

HR told management I have depression without my consent

Hello! I'm not sure how to handle this situation. Any advice? Last Wednesday I requested time off since my depression has been worsening. I had previously brought the request up to my boss before he went on a 2 week vacation. After he left someone had quit and I was stuck with half of their workload while everyone in the company is already overworked and under paid. With the stressors piling up, my symptoms have worsened. I finally cracked and needed to ask for time off. In my conversation with HR I requested a modified schedule for the remainder of the week so I can plan my absence. (I am the head of two departments and have 5 soon to be 7 direct reports.) HR asked my permission to inform the CEO of my request which I agreed to. She explicitly asked to tell the CEO only, no one else. About…
