I used to work at a online car dealership as a truck driver hauling there inventory around, then took a promotion into middle management. I decided I didn't like the work culture in that position and asked to be demoted back to a driver. Upper management's response was that I could go back to driving but I'd lose my almost 3 years of seniority which put me at the top of the list as far as picking routes and what shift I wanted to bid on. I was not about to lose all my seniority so I put my 2 weeks notice in and started looking for a new job. I found a new job working with a small owner operator company that did sometimes haul cars for the company I was currently employed with. To ensure there was no issue with me coming back on site with my new employer I got it cleared through HR that there was no Non-compete contract that would cause any potential problems. The first week I returned on-site working for my new company they said I had no right to be there and that there is a non-compete contract that I was not abiding by and said if I returned my entire company would be banned, so I called HR again stating that I cleared all of this before leaving and asked for a copy of said non-compete contract be emailed to me. They got back with me today stating that there is no non-compete and that it is just the companies decision to not let any former employees haul any of their cars. Can I file a lawsuit for loss of wages or any other reason since they are black balling me from hauling any of their cars without me agreeing to or ever being informed of this policy?
