Sorry, you don’t qualify to go on an unpaid leave yet.

I've been at my current job since December 2021. The pay isn't the best, but my benefits are really good. Back in January, I was made aware of a tumor in my jaw by my dentist. Biopsy confirmed its a cancerous tumor, which I had about a 3% chance of being diagnosed with. Since then I've been seeing various doctors coming up with a game plan to remove the tumor and reconstruct my jaw. My surgery has now been scheduled for April 21st, and I will have to be out of work for 6 weeks. I informed my supervisor who then told me I'd need to speak with HR to apply for FMLA. I went to see HR yesterday, just to be told that I need to be employed with them for a full year to qualify for FMLA. They told me I could apply for discretionary leave, which means…

They told me I could apply for discretionary leave, which means it would be up to my supervisors whether or not I have a job to come back to, and if they don't approve it I can chose to resign and then reapply once I've recovered, but that would mean losing my health insurance in the middle of this. If I end up having to resign I will not return. I just don't understand making me jump through hoops to go 6 weeks without Pay. Same crap either way.
