We pool tips where I work. When we opened, we had leads that functioned like the retail version of head servers, mangers, and a general manger. Managers were on salary and did not get tips. When the company started seeing how much we were getting in tips, they “dissolved” the manager position and instead doled out all of the mundane managerial duties to the leads. The leads now create the schedule, place orders for the store, handle all of the money, allow or disallow time off requests etc. The company pays them a few dollars more an hour and they get an equal share of the tips, just like before. They even openly refer to the “leads” as manager on duty. I’m in California and this is illegal. We have filed two complaints with the state and nothing has happened. We even called to be sure that this was a violation of the fair labor law but literally nothing has changed. Just venting I guess.
