The email I just received from my work. The company tried to circumvent the contract.

Dear blank, In a recent arbitration, the Company was ordered to make a cost of living payment to certain team members, including you. It is important to note that the Company has appealed the Arbitrator’s decision to the Labour Relations Board, as we believe the Arbitrator was incorrect in their decision and it is our view that the Company is not required to make this cost of living payment under our Collective Agreement. However, we did not ask for a stay of payment and we have worked with the Union to determine the amount owing to you arising from this arbitration decision. As a result you will receive a payment for this item on your next pay day. We are currently awaiting the decision of the LRB on this matter. If the Company is successful in the appeal, then the Company may recover the amount paid to you for this…

It is important to note that the Company has appealed the Arbitrator’s decision to the Labour Relations Board, as we believe the Arbitrator was incorrect in their decision and it is our view that the Company is not required to make this cost of living payment under our Collective Agreement. We are currently awaiting the decision of the LRB on this matter. If the Company is successful in the appeal, then the Company may recover the amount paid to you for this item from future wages owed to you, as an overpayment of wages.
