UPDATE- Husband asked to resign today

My husband was told he was terminated on Monday (1/10) and his company had asked him to resign. We were concerned they were trying to trap him into the clawback of the relocation bonus he was paid to move across country (link to original post in comments). We spoke to an attorney this morning who had said the email we had received stating the company would not pursue repayment of the relo on the condition of his resignation constituted a new written agreement and advised us to send the resignation letter clearly stating the resignation is given under these terms. Fortunately the delay that came about from waiting to speak to the attorney the company did not send any communication terminating the agreement re: the relo and had not stipulated any expiration date on the offers acceptance. He also said not to provide a forwarding address, since we now plan to move back to the state we came from, because it would make it that much harder for them to serve him, if they chose to.
