Hoping someone knows what to do here. I'm an hourly w2 employee, and my check was short several hours. My supervisor said the owners didn't believe I was completing work fast enough and one day didn't make the company money so the owners refused to pay me for that day. For one day it took me 8 hours to complete a job that they thought should've taken me four, so they're only going to pay me for four. He also said that one day our work didn't earn the company money, so we don't get paid for that. I then called the owner and he confirmed everything. I explained it was illegal and he said he was still doing it.
My favorite part:
me- “So even though we're hourly employees who are doing what our supervisor told us, we still don't get paid?”
Him-“no, you don't get paid because I'm not getting paid”
Tldr:
-I'm a company window installer for a residential construction company. W2, hourly, Indiana.
-Owner of the company deducted 12 hours from my paycheck because he said I didn't work fast enough and they weren't making enough money off of us.
-I've got texts from my supervisor and two recorded phone calls with the owner to prove they're breaking SEVERAL labor laws, are illegally 1099ing employees and bullying/lying to their customers. .
What can I legally do with this information to make sure they don't get away with this?
