Hello to everyone! I am writing here because I am seeking advice about one of my concerns. One year and a half ago I have started to work as a waiter in Los Angeles, CA, being paid under the table, because I don’t have a valid work authorization. The first few months I was working around 10 hours/6 days a week and being paid around 5,000$ per month. Now, a few months back I have changed my deal with the owner, now being paid 13$ per hour and getting 65% from the tips, the percentage of 35 going supposely to Tax purposes (15%) and to the kitchen (20%), even if the cooks never see nothing. Now I am working around 12 or 13 hours, 6 or 7 days a week. When I am at work I never get a break and I always stay on the call. For the last few months (6 or 7) I have started doing manager tasks, sometimes I am even working in the kitchen and on the same time on the floor. Most of the time I am alone, no one else working on the floor with me (busboy, bartender, server – I have to do all these jobs, and more side tasks) just a part time waiter coming from 6 to 9. Now, the owner told me he is going to take more from my tips because, a higher percentage, because I started to make more tips and he has to pay more taxes and he doesnt afford. My question is, can I do something against him or should I just look for another job? I never got paid OT, never got a break, working straight 12-13 hours or maybe more, got paid under the minimum wage, a few months didn’t received nothing from the tips and now I get only 65%, 35% going to his pocket.
