WTF: “Hired”, worked 2 shifts, never heard from employer again

This started in the summer and happened to my kid (D). Maybe your speculation about what's going on is better than mine, and, of course, advice appreciated. We live in NYC. In July, D was hired at a local ice cream parlor, a locally owned franchise of a national chain. To date, D has worked two 4 hour shifts, for which he has been paid. Both shifts were in late July. When D asked for a schedule, the employer said “I'll let you know when I want you to come in.” So far, that hasn't happened, and the employer has not officially dismissed D, nor has D officially resigned. In the meantime, the employer has continued to advertise open positions on job boards. I had posed a question elsewhere looking for advice on NYC's fair workweek law. We've filed a complaint anyway, because D has never seen a schedule, but…

I had posed a question elsewhere looking for advice on NYC's fair workweek law. We've filed a complaint anyway, because D has never seen a schedule, but we have about 4-6 more weeks before they said it might be resolved (they said 10-12 weeks when we submitted it). I don't know what to expect in case this resolves in D's favor, but I guess I'm mostly just curious WTF is going on with this employer. Digging into this business, I saw that he's reporting a staff of several dozen. Am I wrong in thinking this guy is doing something shady? Is he padding staff count for some kind of business loan?

How would y'all have handled this? Any other advice besides pursuing the fair workweek complaint?
