On the hunt for a job, aaaaand . . .

I’m in the US, looking for a better-paying job. I applied to one, got to the EEO stuff, and it asked me my pronouns. Ok, no harm there, I do have a unisex name, and in this day and age you never know. But then it asked me if I identify with my legal gender. The options were “yes”, “no”, and “I don’t know”. No choice to decline to answer. Is this legal? Would this fall under the categories that can’t be asked at work, like religion and sexual orientation, or is this a way to legally screen out trans people?
