Helped needed – HR and manager (who I reported) retaliating against me in unethical ways.

Been working at this job for nearly 2.5 years. I have two “managers” – one is a “functional” manager, the other is my project manager.

The “functional” manager started treating me like crap when I was put under his project temporarily for a few months. Since then (even after switching back to other project), he has treated me like garbage, such as:

  • micro-managing (check-in emails for status when I come into office and leave), acting like I don't do work (even under my former project I'm back on now) & questioning performance
  • accused me of basically faking COVID-19 sickness and other health obstacles that made me unable to work for brief periods of time.
  • condescending attitude towards my other project (while under his)
  • forcing me to move hallways to work on his project, then still to this day neglecting to allow me to move back to my former hallway (when other teammates moved back already)

A month and a half ago, he took away my 2 remote days – without providing an explicit reason or proof – despite saying in front of my project manager that I “have done a great job for your former project” before telling me this. (For context: everyone else on my team still has 2 remote days)

Immediately after, I decided to report him to HR with a massive e-mail detailing everything. Fast forward now, and as you guessed it – HR quite literally did nothing.

Then, a month ago, HR set up a meeting with me and the manager and told me that I “have not worked many full time weeks” by looking at my time card – citing weeks that I had taken PTO (which I rightfully used) for one day every week or so a while back. Since I had no PTO left, I was told I can use unpaid leave for the days I am sick – which I only used ~3-4 times since. HR also said if I am not full time, I will need a Performance Improvement Plan.

Earlier this week I had a “follow up discussion” and was told by HR that since I “only worked 2 full time weeks” in the past 5 months – excluding weeks I took PTO as not full time – that I am given a “final warning” for “excessive absenteeism” and given an “Employee Counseling Report” that I sign for acknowledgement. I was also told I can't use “unpaid leave” anymore (which was my only option for days when feeling unwell / sick)

I am 100% certain this is both retaliatory behavior, and unethical as HR cannot punish or warn me for not only something that is my entitled benefit but also which I used months ago with no issue (until I ran out of it).

Edit for context: This “functional” manager has given me raises and bonuses every semi-annual performance review / holiday and I have never received a former complaint or warning about my performance from him or my project's manager until now. I always met deadlines and deliverables, and went the extra miles when necessary.

Our company was recently acquired by a bigger company – which has an “ethical hotline” that I can call or send an e-mail to. I have recently started writing up a massive e-mail that documents everything they are doing and plan to send it to that hotline this Monday.

Any other advice or help would be appreciated.
