Are employers allowed to avoid paying overtime in TN?

So, one of my aunts works at a hotel cleaning, they are told not to go over 40 hours but when there is a lot of work they let them, but only pay them 40 for that week and the rest are paid the following week at the same hourly rate, that way they aren’t paying overtime even though they are working it. Is this legal? Apparently they have been doing this for a long time and she just now told me. Is this a legal loophole so that they dont have to pay their employees what they are owed? The business is family owned and she thinks it is legal because it is somewhat of a small business.
