This took place in South Dakota.
I put my three week notice in last week and on Monday I felt I’ll so I called in sick. I got a positive Covid test and informed my employer that I have to isolate and won’t be able to work. Today, Wednesday I got a call from employer saying they don’t need me anymore and they have someone to replace me tomorrow.
So they didn’t specifically say they fired because of missing work and the employer has a history of firing people after they put in a 3 week notice. Unfortunately I still have them notice and shouldn’t have.
Did they do anything legally wrong? If I can’t get them to admit that they fired me due to being out sick would I have a case of wrongful termination?
Either way I am eligible for unemployment correct?
