The gas station I work at keeps scheduling me for 3 hour shifts which I thought were not legal in NYS (or at the least that my employer would then have to pay me for 4 hrs) but I keep finding conflicting information on what a minimum shift has to be (or what has to be paid) in NYS. Almost everywhere I look says an employer has to schedule you (or pay you) for at least 4 hours in one shift. However I've also found in section 142-2-3: (1) Reporting to work. An employee who by request or permission of the employer reports for work on any [day] shift shall be paid for at least four hours[, or the number of hours in the regularly scheduled shift, whichever is less, at the basic minimum hourly wage] of call-in pay. I had the misfortune of reading a laughably bad report on a case by the National Society of Professional Engineers (NSPE) Board of Ethical Review about engineer membership in labor unions. Granted, the source was published in 1962, but when I Googled “civil engineering unions” it is the second result that comes up, so it seems to likely still hold some sway today. And even on their own website, when searching “union,” it is the second result, with the first one being less directly applicable, and still very critical of engineer union membership. I’m a delivery driver that drops off packages. I’ve only been doing it since November. My manager is a guy who is burnt out and planned on leaving weeks ago but was convinced by corporate to stay. Basically, every time I even talk to my manager he acts like I’m questioning him or telling him what to do when I’m simply asking questions because I want to know how things work. When I bring up things about the truck that need fixing he gets irritated. So it's about that time where I feel that it's time for me to depart from my job, for various reasons. Over time at work me and my most direct colleagues have vented to each other about the job. It's a small team of just 4 of us. We're all on the same level of authority, one being a team lead.
