Employer thought I was resigning… actually going on maternity leave

am due in March and told my employer that I am expecting last fall. Unfortunately I was laid off from my job I was at for over a year so I don’t have FMLA protection with my current employer. When I initially met with HR I was told they don’t have any maternity leave policies or benefits which was very discouraging- not to mention I have unlimited PTO and sick time which also can’t be used or applied. The director of HR said he would get back to me on any updates as he wanted to see if anything could be done. It’s been 3 months and they haven’t given my any updates. When I initially met with HR I was told they don’t have any maternity leave policies or benefits which was very discouraging- not to mention I have unlimited PTO and sick time which also can’t be used or applied. The director of HR said he would get back to me on any updates as he wanted to see if anything could be done. It’s been 3 months and they haven’t given my any updates. I’ve asked for information and I’m met with a dead end each time.

Mostly I wanted to take some vacation time before my due date to prep and at least have some paid time off while I’m out. They also won’t tell me how many unpaid weeks I can take- to add to it might have to be induced at 38 weeks which is about a month away.

This is so frustrating and stressful. I already suspect they are going to get rid of me while I’m on leave however I’ve been trying to do the right thing.

I’ve also been saving messages and conversations about how I’ve been doing a great job so I can potentially use it if I do get fired and the paper trail of them ignoring my leave questions

Has anyone encountered this? They keep ghosting me and I know they’re going to fire me or get rid of me which even if I’m not covered under FMLA I still feel that it’s pregnancy discrimination.

Also not to mention they silently posted my role.
