Not sure if this is the best sub or but I am unsure about what steps to take regarding my current employment, using a throwaway for obvious reasons. For background, I started working in this position in August 2022. Since starting my job I have not had available access to any of my paystubs. When asking my boss about them, he slacked at getting me the login information for QuickBooks and I did not receive access to my W2 forms or paystubs till last week during tax season.
Once I got access to my W2 forms, I noticed that I was not receiving overtime pay on any of my paychecks. After working over 800 hours at approximately $16/hr, I noticed that my federal income taxes paid were only $219. When informing my boss about this, he deflected the blame on the payroll company and said that he would try to get it resolved. It has been about a week and I have not received my overtime pay, but he informed me that he could put it on my next paycheck this upcoming Friday.
On the subject of paychecks, about half of my paychecks have been cashier’s checks. Our direct deposits were not coming in on time and to mitigate the issue, our boss saw cashier’s checks as being the solution. Now we may owe money in taxes because of check’s we believed were being taxed. I know that all of my co-workers have the same issue with their W2 forms too and I want to make sure it gets resolved soon because I anticipated a pretty sizable tax refund this year but now it seems like my paychecks have not been taxed for several months.
Moving forward, I want to know what steps to take legally or how long I should give my boss to get this issue corrected. It seems unfair to owe taxes to the government for paychecks I assumed were taxed. I have been in the dark about my finances and now I feel like I am owed several thousand dollars for overtime and tax money. I have kept a very detailed spreadsheet regarding my hours worked and overtime pay required. I also have copies of all of the cashier’s checks I was paid.I am looking for another job in the meantime, but I would appreciate some advice on what to do now.
