So I am in the UK and have noticed what I think is quite an odd clause in employment contracts, saw it in the contract for my last job, thought it was them just being shady. But my new job also has the same clause in their contract.
Essentially it states that if you are off on sick leave for any period, then are awarded any form of compensation for that injury/sickness. The employer has the right to recover the sick pay they've paid to you over the course of your employment, they can recover all sick pay up to the entire value of the compensation.
Which seems really odd to me, I understand it slightly more for my current job since they are a government organisation, so you could make the argument that the government are making the payments and recovering them. But my previous job had this clause as well but did not pay any sick pay, it was entirely statutory sick pay from the government.
That seems really unfair if the government are paying you sick pay, then this company are taking your compensation as a result despite not making any contributions to that sick pay.
I was curious as to whether anyone else has encountered the same thing in their contract?
