Laid off Because of California AB 5 or Jerk Boss?

My mother (early 60s) was just told that she's been laid off after 42 years of employment. My parents have been talking about moving out of state (CA to TN) for a few years and about a year ago, she asked her boss about making her job remote. She works in the office handling complaints and other things like that for a franchisee of a national chain. He told her that it would work, made her write up her job description to figure out if anything couldn't be remote, what could. They sold the house in November and are leaving the state next week. Last week, he told her that because of California AB 5, the lawyers have told him, she can't go remote for him as he has no physical location in the other state. Because it was only a verbal agreement, so I'm concerned there's no recourse. But…

Note: he is currently being sued for not protecting a staff member for being sexually harassed. His lawyers claim that because my mother is a witness for them, it would look like a payoff.

Note: They've offered an 8 month severance and told her that don't have to offer her anything.
