Need help/advice

My employer asks that if multiple employees are in a company vehicle only the driver should be clocked in. For example, two employees arrive at work, clock in, and get a company vehicle ready for the day. They start driving to whatever project we have to work on and the passenger clocks out while the driver stays clocked in. Then they arrive at the location for the project and the passenger clocks back in. I can’t tell if there is anything illegal about this or if it’s just an annoying policy. Any advice on how to figure out if this is allowed?
