Robbed of 3 years of 401k

I’ve been at my company for over 3 years and have received multiple raises and promotions. When I first got hired, I tried to enroll in my companies 401k plan and was unable to submit it even though I had filled everything out correctly. I brought this up to my supervisor and HR, HR said they would take care of it. Fast forward 3 years, I’ve applied the same way each year during open enrollment and have still not been able to get set up. Now with a new head of HR, they claim they’ve fixed the issue and will offer back pay to anybody who has been unable to enroll. Is there any legal action I can take?

TLDR: haven’t been able to sign up for 401k for 3 years. HR promised to fix the issue and offered back pay on amount missed then revoked the backpay.
