I’ve been at my company for over 3 years and have received multiple raises and promotions. When I first got hired, I tried to enroll in my companies 401k plan and was unable to submit it even though I had filled everything out correctly. I brought this up to my supervisor and HR, HR said they would take care of it. Fast forward 3 years, I’ve applied the same way each year during open enrollment and have still not been able to get set up. Now with a new head of HR, they claim they’ve fixed the issue and will offer back pay to anybody who has been unable to enroll. Open enrollment is back open again and I let HR know I will not be enrolling until I receive my back pay, to which they responded “we are not offering back pay to employees who were previously unable to enroll in our 401k benefits package.” Basically just wondering what to do, I want to quit but I feel I’m losing out on so much money by doing so. Is there any legal action I can take?
TLDR: haven’t been able to sign up for 401k for 3 years. HR promised to fix the issue and offered back pay on amount missed then revoked the backpay.
